Update on the Class Action against Pawnbroker, Taylors Business Pty Ltd, located in Delahey, Victoria

Consumer Action Law Centre (Consumer Action) is conducting a class action against Taylors Business Pty Ltd (ACN 107 445 723), located in Delahey, Victoria.

What are the legal claims and orders sought?
The class action is being conducted in the Federal Court of Australia.

It alleges that from 15 November 2022 to 26 October 2023, Taylors Business amongst other things:

  • Charged prohibited interest at an equivalent rate of 480% per annum, being 432% higher than the highest permitted rate of 48% as provided for in the National Credit Code and the Consumer Credit (Victoria) Act 1995;
  • Entered into pawnbroking contracts that contained unfair contract terms in the nature of the interest charged;
  • Engaged in unconscionable conduct and entered into unjust transactions; and
  • Engaged in unlicensed credit activity in that it engaged in credit activities without holding an Australian Credit Licence.

Consumer Action is seeking, amongst other things, orders that Taylors Business return any pawned goods, pays compensation and penalties to Group Members and orders that Group Members are not liable to pay further charges.     

Are you a Group Member in the Taylors Business Class Action?
If you entered into a pawnbroking contract with Taylors Business from 15 November 2022 to 26 October 2023 (inclusive), you are a Group Member in the Taylors Business Class Action.

You are a Group Member even if Taylors Business has returned your goods to you and/or you have repaid your pawnbroking contract.

Do I need to register?

What do I do if I don’t want to be part of the Taylors Business Class Action?
Even if you meet the description to be a Group Member, you do not have to be a part of the class action.
